Coverage and Payment Disputes with Related Risk Analysis

Appeals, Audits, and Overpayments

Representation in Original Medicare redeterminations and reconsiderations under Parts A and B; plan-level and independent review proceedings under Parts C and D; OMHA adjudication; and Medicare Appeals Council review. Responses to Additional Documentation Requests and representation in MAC prepayment and postpayment medical reviews, Targeted Probe and Educate, Recovery Audit Contractor, Supplemental Medical Review Contractor, Unified Program Integrity Contractor, and CERT reviews, including appeals of resulting claim denials and overpayment determinations. Prospective review of documentation and billing practices to identify recurring claim vulnerabilities before they affect additional claims or draw heightened scrutiny. For providers and suppliers, the analysis may also identify circumstances requiring corrective action or a broader compliance response.

Interpreting Medicare Policy at Every Level of Review

Clinical judgment alone does not establish Medicare coverage or payment. A decision may turn on the interplay among statutes, regulations, judicial precedent, national and local coverage determinations, CMS rulings and program manuals, contractor instructions, the OMHA Case Processing Manual, and applicable precedential Medicare Appeals Council decisions. These sources do not carry equal legal weight. I distinguish binding authority from interpretive and procedural guidance, determine the weight each carries, and apply each source according to its proper role in evaluating the record. My experience with OMHA adjudication and Medicare Appeals Council review provides insight into how issues are treated at successive levels of appeal. A complete appeal traces each issue through the prior decisions, identifies what remains unresolved, and organizes the legal and evidentiary presentation in direct response to the anticipated questions at the next level of review.

Building the Record at Redetermination and Reconsideration

Redetermination and reconsideration establish the foundation of an Original Medicare appeal. Evidence first submitted at OMHA may be excluded when the good-cause restriction applies, making early development of the record essential.

A well-researched submission responds directly to the stated denial rationale, applies the policy on point, and links each contested requirement to the documentation that supports it. This gives OMHA and the Medicare Appeals Council a coherent legal and factual basis for the requested result.

OMHA Appeal Assessment and Preparation

Reconsideration marks a critical transition. Before proceeding to OMHA, I reassess the entire case to determine the appropriate course. A hearing is not an automatic advantage. Testimony may resolve a factual dispute, but it cannot replace documentation required for coverage or payment and may instead expose deficiencies, particularly when the QIC or MAC participates. If additional material evidence is available, I address any good cause requirement for its admission. Based on that analysis, I advise the client whether oral argument, lay testimony, or expert opinion would meaningfully advance the appeal, or whether the matter is better decided on the written record. Prudence requires grounding the case before the ALJ in both the correct law and the evidentiary record because a favorable decision may still be modified, reversed, or remanded on Medicare Appeals Council review.
